In 1909, the FDA seized some coca- cola syrup and filed charges against the company partly because the syrup contained caffeine.
In the evening of Oct. 20, 1909, U.S. government agents had set up a stakeout at the Tennessee state line. They were waiting there and watching for a truck that was coming from the Coca-Cola plant in Atlanta. That truck was on its way to the bottling plant in Cha ttanooga. When the truck arrived agents intercepted the truck and seized its cargo which contained 40 barrels and 20 kegs of Coca-Cola syrup.
The seizure was made under Pure Food and Drug Act which was passed recently . After this the government charged the company with crime of marketing and selling a beverage which was injurious to health of people because it contained a harmful ingredient named as caffeine.
