In this case it will be a civil lawsuit since there is no damage to property or to a person it is just a deemed failure to pay a portion of the rent so the case will have to be heard to see if there are any extenuating circumstance. Also, since the two women could not agree on a solution, then they can bring it in front of a judge (like people do with Judge Judy) to hear the evidence and rule on the case.
